There is no consensus in Brazil about the nature of Family Law. There is a strong tension between the understanding that it is a matter of Public Law and that it is a matter of Private Law . In addition, there have been a series of legal and interpretative changes in the recent past that have generated and still generate significant legal uncertainty regarding family law, especially marriage.
